No jail time is the BIG One! No fine is better, but secondary. There are now 4 ongoing petition drives to put LOCAL SC town/city cannabis decriminalization on local SC ballots (Charleston City, Charleston County, Town of James Island and Folly Beach). South Carolina IS a "Home Rule" state! So, if enough signatures of registered voters (from that area) are collected and verified, the decriminalization issue can appear on local ballots. Then, if passed by voters, nobody in that same area will get thrown in jail for simple possession (of 1 ounce or less) by local cops. South Carolina's prohibitionist State Attorney General Alan Wilson might dispute whether this is legal or not (it is). You may recall his stupid statement from 2019, "Marijuana is The Most Dangerous Drug in America." What an IDIOT!

That AJC article is behind a paywall, so here is the story from Online Athens. Here is the list of other Georgia municipalities that have passed similar measures: Atlanta, Savannah, Macon-Bibb, Statesboro, Tybee Island, Clarkston, Chamblee, Forest Park, Kingsland and South Fulton.

Quote: "The fine was set at $35 because there is a mandatory minimum surcharge from the state. According to Commissioner Mariah Parker, the minimum required fine would go to the county law library, the sheriff's retirement fund and the Peace Officers' Annuity and Benefit Fund." Extra money for the local library sounds good. But, fine money funding for the Sheriff's RETIREMENT Fund and Peace Officers' Annuity and Benefit Fund? That gives cops a big incentive to issue LOTS of fines!

For SC citizens using Home Rule to put cannabis decriminalization on a local SC ballot, it takes over 10% of registered voters (from inside that area) signing a petition. If enough people do sign and it is approved by town/city/county election officials, at that point it goes on the ballot (to then be voted up or down).

This makes it easier to get the decrim issue on ballots in smaller communities and harder in larger communities because many more signatures are required. In Folly Beach, SC for example, ONLY 400 REGISTERED VOTER SIGNATURES are required! Because of so many tourists there, it may require us to go door to door.

Many here may not know this, but both the Charleston City cops and Charleston County Sheriff's Office have quit making simple weed possession arrests. This really helped to clear over-crowding in their jails. It's TIME for SC laws to reflect this reality. All who support these much-needed changes should get involved!

As to which town/city will be FIRST in SC? I'll say Folly Beach simply because SC NORML (National Organization for Reform of Marijuana Laws) is based there. https://scnorml.org/
