Not that he shouldn't go to jail for that (although spoiler, he won't), but the article looks more than a little biased, claiming that the car was "forced to swerve left" into oncoming traffic. According to the reports it is citing, it sounds like one truck swerved right off the road to avoid a head on collision with him and the driver behind that truck for some reason swerved into incoming traffic rather than off the road. Not really judging that driver; who knows how you will react if there is suddenly a car coming at you in your lane, but obviously you'd hope you swerve off the road before swerving into oncoming traffic. Just sucks that one of the people he was passing died instead of Lacy himself.
But it really sucks that I bet that gives them a fig leaf (if they even need it; I know it's hard to get civil liability against a car that didn't physically touch another car, even if they were the cause of the wreck and there may be something similar here). They'll claim that while he was negligent, he can't be held criminally responsible for a car choosing to swerve into oncoming traffic when there's no proof it couldn't have avoided any collision by hitting the breaks and staying in its lane in time, of if accident reconstruction shows there was no way to avoid the wreck, that the person chose to go into incoming traffic rather than run off the road like the car in front of it.
Hope I'm wrong about all that.
