State College neighborhood complaining about high school band(and football practice under the lights).

Sooooo, many years ago there was a campaign being run in State College to pass a property tax increase in order to build a new high school to replace the North and South buildings of the high school(Westerly Parkway, a busy street, separated the high school). This campaign was run like a political campaign(videos showing how run down some portions of the school had become, lawn signs everywhere, etc). I am not disagreeing that a new high school needed to be built. There was a lot of debate on whether to build/consolidate the new high school on its current footprint in town next to neighborhoods or move it to available land outside of town in open fields. Those in the neighborhoods around the school seemed to fight tooth and nail to keep the high school where it was and made statements about moving the high school would decrease their property values yada yada yada... Final results was new high school on current footprint.

Now, move fwd to 2018, new school is finished and they put lights up on a turf field(with a track around it) that has always been behind the school and backs up to mostly student apartment complexes on Waupaleni Drive. There was an udderance of complaints from this same Greentree neighborhood complaining about the lights being on until 11:00 PM and so the school district agreed to turn them off by 9:00 PM I think. Now several years later the Marching Band needs someplace to practice at certain times into the evening. (The band used to practice daily on a parking lot on the North side of the street). Now this same Greentree neighborhood is complaining about the marching band practicing until 8:45 2 nights a week for 10 weeks and about the football team practicing under the lights in the fall. The comments at a recent meeting have me scratching my head that neighbors are saying they can't hold a conversation or watch TV inside their homes while the band is practicing. Granted I am not in these peoples house but these houses are not right next to the field but about a football field or more away(based on the pic in the article).

Now, the complained about the high school moving and are now complaining about the high school being there. Then on the other side, the band leader/admin person complaining about moving the location to the lighted field on the North side and the kids lugging their instruments to the other side of the street. Granted it is a long walk and I know some kids in the band may not be able to lug their stuff that far but the school district does have a buildings over there where they can store the music stuff(actually the music/band room used to be over there and this sort of looks like poor design planning).

I am an outsider who moved into this town from the Philly burbs and find these complaints from residents living next to high schools absurd. [There was another such situation in this town where people started using a park in a neighborhood again and the people living next to it complained about the noise playing pickleball made and there for pickleball has been banned from the park]. Is it this town or does this happen everywhere?

I would like to hear other opinions on this.

The track has been there for decades. I completed on it in junior high as a student a Westerly Parkway JHS. The lights initially went up when Memorial field's construction timeline went long and the Little Lions needed a field to play on. When I was a State High, we practiced on Community Field and obviously played on Memorial Field. There have been track meets and Junior High football games for years at that facility, but the band and football practice is new. Some of the homes are right on the other side of the fence from the track, I'm sure it is noisy. I live about a mile from our high school here in Ohio and can hear our band practice. I think there needs to be some concessions on both sides. While those homeowners knew they were buying near a school and an athletic facility, the lights and band noise is new. It's not like the people that bought in the fraternity district and then complain about the fraternities that have been there for decades prior to their homes. The band use to practice on the parking lot in front of the junior high, that doesn't exist anymore. The band director claims they have lots of kids with mobility issues so they can't get their instruments at the band room and walk across the street to practice on the north field or parking lot. This is a marching band, how do the have mobility issues? Is so, can't some carry their instrument for them?

The school will need to bend or they will not win in court as I think the homeowners can every easily show their properties impacted by the noise and light.

This sounds like people who move near an airport and then complain about the fact that there is an airport near by.

This happens everywhere.

Our local high school is renovating the softball field and adding lights that will be permitted until 9pm. Neighbors complained, except that between the new field lights and their houses is the high school parking lot....which is lit 24-hours a day....and has been for 40+ years.

One parent complained that their child is still a toddler and goes to bed earlier then 9pm and won't be able to sleep due to the light pollution. I asked her if her child naps during the day....you know, when the sun is out...what does she do then? She said, "I pull the shades down".

The track has been there for decades; end of discussion. If you lived there before the track etc. was built you have a complaint. Otherwise why did you move there?

But how would something like this end up in court? Unless the band is violating a noise ordinance, or the lights violate an ordinance, there is no cause of action for any property owner. At least I cannot think of one. Their property values may decrease, but unless the school is doing something illegal, I don't think there is any recourse.

There are issues about the zoning of part of the schools land. And yes the home owners can sue for diminished value of their property.

Worked on the design of the original SCHS renovation back in the day. It was a very politically charged effort as taxes were to be raised considerably since nothing had been done to the school for decades. Bids came in high and the process became mired in public debate and threats of lawsuits long enough that the school board changed enough in the next election to defeat the project. Best damn kind of design work you can get - paid for all but the CA phase of your work and it gets shelved and you never have to deal with the headaches and aftermath of it being built!
