23XI, Front Row cite 'additional evidence' for re-filing motion in NASCAR lawsuit
Another development in the NASCAR lawsuit from 23XI Racing and Front Row Motorsports. This time regarding the preliminary injunction. The teams are going to re-file for another motion to receive an injunction after their first failed.
23XI Racing and Front Row are citing a change in circumstances for why they are refiling their motion for an injunction. They are adding evidence and are seeking to have part of the motion sealed.
Bob Pockrass of FOX Sports reported on the new filing this evening.
“Plaintiffs intend to file a motion for preliminary injunction in the district court with additional evidence of changed circumstances,” the teams stated, via Pockrass.
NASCAR waived the clause in the open agreement that prevented teams from suing over antitrust claims. That clause in the charter agreement is at the heart of this lawsuit against NASCAR. With that change in the open agreement, the teams now have a different argument to make.
The teams were appealing the original injunction, which was denied in district court. Now that the facts have changed, and apparently, there is new evidence, they are going back to district court to make a new motion.
While there have been a few exchanges in this case so far, there is a long way to go. Appeals and motions and discovery and a lot more is going to go down before we see this end.

NASCAR lawsuit takes new turn
So, there is a lot that is being said about 23XI Racing and Front Row in the NASCAR lawsuit. If they believe that NASCAR is a monopoly and unfair and this and that, why are they buying more charters? Why are they going to race as open cars?
These are stock car racing teams. NASCAR is the only major series for stock car racing in North America, and arguably the world. It would be like asking why the Chicago Bulls don’t go somewhere besides the NBA if they feel unfairly treated.
The argument has nothing to do with 23XI Racing and Front Row wanting to do business with NASCAR. NASCAR is the only place they can do business. The argument is whether or not the sanctioning body has an unfair competitive advantage in terms of the market.
The NASCAR lawsuit is ongoing. We are going to have a lot more updates and changes and things going on between now and the 2025 season. Then we will likely see it continue on into the season.
