23XI Racing, Front Row Motorsports attorney decides on appeal, issues statement after injunction denial
Today a decision was made in the 23XI Racing, Front Row Motorsports lawsuit against NASCAR regarding the preliminary injunction. That was denied, however, the teams did receive good news today ahead of championship weekend.
Jeffrey Kessler, attorney for 23XI and FRM, released a statement today. The judge may have denied their preliminary injunction, citing it was perhaps too premature to request. Despite that, the judge also approved to expedite discovery and “fast track the schedule” in the NASCAR lawsuit.
Things are only heating up in this lawsuit. 23XI Racing and Front Row Motorsports are going to try to be in this for the long haul. We will see what the next steps are soon enough. The teams are appealing the decision on the injunction.
Here is the full statement from Kessler representing 23XI and Front Row:
“We are pleased with the court’s decision to expedite discovery and fast track the schedule in our case against NASCAR,” Kessler said of the lawsuit. “Although we are disappointed that the preliminary injunction was denied without prejudice and as premature which we intend to appeal, this denial has no bearing on the merits of our case. My clients will move forward to race in 2025 and continue to fight for a more fair and equitable system in NASCAR that complies with antitrust law.”
Again, this is only the beginning. 23XI Racing and Front Row are going to appeal the decision on the injunction. Now with expedited discovery, we are likely going to see more come out in this lawsuit with regard to NASCAR and their business.

NASCAR lawsuit, championship collide this week
With Tyler Reddick in the Championship 4 it puts the NASCAR lawsuit in a brighter light as well. There is a lot going on at the track and the news from the North Carolina courthouse has likely made it to the track, it’s going to be all a-buzz.
Reddick has a chance to follow up his regular season championship with the big one this Sunday. He will have a tough time doing it, because his competition is stiff. Ryan Blaney and Joey Logano have given Team Penske the last two championships.
Then you look at a driver like William Byron. He has won at Phoenix in the past. As the only Hendrick driver in the finale, he will have the full might of that organization behind him.
