Attorney for 23XI Racing, Front Row Motorsports issues statement after winning crucial ruling

After a big ruling in the NASCAR Cup Series charter transfer to 23XI Racing and Front Row Motorsports, the lawyers for the organization released a statement Monday.
A judge ruled earlier in the day that there would be no delay on the injunction order permitting the transfer from Stewart-Haas Racing, which means the transfer can officially take place. That means both teams can continue with expansion as planned for 2025.
“We welcomed today’s decision by Judge Bell to deny NASCAR’s motion to stay, which will allow 23XI and Front Row Motorsports to compete as chartered team’s in the season and enable Front Row Motorsports to complete their purchase of a third charter from Stewart-Haas Racing,” the statement from attorneys read. “Today’s decision represents an important step in advancing my clients’ case against NASCAR and their monopolistic practices, while protecting their drivers, race teams, sponsors and the fan experience.
“We are confident in the strength of our case and will continue this fight for a more competitive and fair sport for everyone involved in the coming year.”
It was reported that NASCAR plans to appeal the decision. The lawsuit as a whole has gone through a few back and forth between the Defendants and Plaintiffs. Last week, the court partially granted a motion to stay part of the preliminary injunction that was granted previously.
23XI Racing and Front Row Motorsports will face NASCAR in a hearing on January 8, 2025, regarding the motion to dismiss as well as other motions in the case. Discovery has a deadline of September 19, 2025.

If there is no settlement reached between the parties, a trial could begin on December 1, 2025. Going the long haul, the lawsuit would last the entirety of the 2025 NASCAR schedule. In the event of a trial, there is a deadline for that as well. The court is seeking to complete the trial before the 2026 Cup Series season.
