Sexual assault lawsuit against Dak Prescott dismissed
The sexual assault lawsuit against Dallas Cowboys quarterback Dak Prescott has been dismissed, according to WFAA-TV. Judge Angela Tucker made the decision Wednesday.
A woman accused Prescott of sexual assault in 2017 and initially filed the lawsuit in Dallas County, demanding $100 million to not take her case to the police. However, in April, her lawyer said the plan was to re-file in Collin County. After the judge dismissed the case Wednesday, a September hearing was set to make a decision on potential legal action against Prescott’s accuser.
Prescott’s attorney Levi McGathern also released a statement on the decision. He called the woman’s claims an “extortion plot” against the Cowboys star quarterback.
“The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak,” McGathern said, via WFAA. “These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them.”
Prescott previously addressed the allegations against him in April, expressing his confidence that the truth would come out. That came after the case was moved, and he said that didn’t change his legal team’s approach.

“I know the truth,” Prescott told reporters at the Texas Children’s Cancer Fund Gala. “I’m confident in what we filed. Very confident in what we filed. I know some things have changed in their sense in where they filed, but that doesn’t have any weighing on what we’re doing and how we’re going about our lawsuit.”
Police previously said Dak Prescott wouldn’t face charges
In May, Dallas Police said the department would not pursue charges against Prescott due to a lack of evidence. The woman also planned to dismiss his countersuit, and McGathern called that decision “nonsense.”
“The Defendants’ Motion to Dismiss is total nonsense,” McCathern said. “They have yet again misrepresented the relevant facts and misconstrued the law as it applies to them.
“We are going to show, plain and simple, that this case is about the ridiculous attempt by Victoria ‘Bailey’ Shores and her lawyers, Yoel and Bethel Zehaie, to extort Dak Prescott out of $100 million based on fabricated allegations, which could not be further from the truth And, now that Dallas County has rightfully closed its investigation into the Defendants’ false allegations regarding Mr. Prescott, we intend on promptly filing claims against the Defendants for malicious prosecution.”
