Judge partially grants NASCAR request for delay of injunction for 23XI, Front Row

After filing an emergency motion to stay the sale of the Stewart-Haas Racing charters, NASCAR has been partially granted that stay. The sale of SHR charters was to be completed today, but the court will now review evidence from the sanctioning body and make a ruling on Monday.

This is a temporary win for NASCAR. Although the order from the court stated it is only valid if the transfer of the charters wasn’t already completed. But it doesn’t seem as though they were completed this morning.

NASCAR is getting a fair shot here. Judge Kenneth Bell will consider the evidence. Then he will make a ruling.

The ruling from the court:

“Having considered the motion, the Court finds that it should be partially GRANTED. The Parties to this action passionately hold opposite positions with respect to time sensitive contracts and other business dealings as explained in detail in the Court’s Preliminary Injunction Order (Doc. No. 74).”

The reason why NASCAR and the teams have gone back and forth on this matter is simple. This preliminary injunction makes or breaks the lawsuit. It gives the teams a ton of leverage and allows them to race as chartered cars.

Not to mention, it will allow them to complete the purchase of the Stewart-Haas charters. All of that hinges on this ruling that will come on Monday, December 23.

Judge sets boundaries for NASCAR

In the order, the judge does make it clear that this matter will end shortly. 23XI Racing and Front Row will get a chance to respond. NASCAR will not be able to file a reply. At least as it pertains to this preliminary injunction.

“With respect to the timing of Plaintiffs’ response to that motion, the Court finds that it would be unreasonable to require Plaintiffs to respond in a single day. Plaintiffs shall have until December 23, 2024, at 10:00 a.m. to file any response to Defendants’ Motion to Stay Pending Appeal, and Defendants shall not file a reply.”

NASCAR has filed an appeal with the U.S. Court of Appeals. So, there is one more out for them in the event this ruling ultimately goes against them.

The teams are hoping that they can retain the entire injunction. Only a few more days and we will have a ruling from the court.
