NASCAR lawsuit update: Insider reveals grim charter outlook for 23XI, Front Row in 2025

NASCAR is not backing down from its stance on not giving a charter agreement to 23XI Racing and Front Row Motorsports. A fan asked Fox Sports NASCAR insider Bob Pockrass if NASCAR would force 23XI and Front Row to sign a new charter agreement if the lawsuit is dismissed.

“NASCAR says charter agreement is off the table for 23XI and Front Row,” Pockrass wrote on X (formerly Twitter). “So only ways, unless NASCAR changes its mind and re-offers their two charters, for them to be charter teams would be for teams to win injunction or teams sign charter agreements for transferred charters.”

On Monday, NASCAR filed its motion to dismiss and general answer to the lawsuit. NASCAR argues that the teams “just didn’t get what they wanted in the 2025 charter agreement, and that is not an antitrust issue – and even if it is, that most of the conduct that the teams allege violates antitrust law occurred beyond the statute of limitations of four years,” per Pockrass.

“Plaintiffs concede the Charters are ‘worth millions of dollars’ and NASCAR increased the revenues available to teams. … If NASCAR truly had market power, it would be decreasing its demand for Plaintiffs’ services and lowering the amount by which it compensates them,” NASCAR argues.

More on the NASCAR lawsuit and 2025 charter agreement

The teams have asked for an injunction to force NASCAR to allow 23XI and Front Row to sign the charter agreements but continue the antitrust lawsuit. Pockrass also mentioned that a hearing date for the judge to consider that injunction motion or the motion to dismiss has not been set.

All the Cup Series teams except 23XI and Front Row signed the 2025 charter agreement in September. 23XI and Front Row view the new deal as “unfair when it comes to revenue distribution to the teams in combination with the restrictions,” which led to them filing the lawsuit.

“I did it for the smaller teams as well. It’s not just me. I think everybody should have an opportunity to be successful in any business,” Michael Jordan, NBA legend and co-owner of 23XI with NASCAR driver Denny Hamlin, told Fox Sports on Oct. 6. “My voice is saying that it hasn’t been happening. … Hopefully we [at both sides] can come to our senses and figure out something that can make sense for everybody.”
