New court ruling means Florida State Basketball's Primo Spears could play immediately

Georgetown guard transfer Primo Spears posted these photos on his Instagram account during an official visit to Florida State on Saturday. He is choosing between the Seminoles and Kansas.

The Florida State men’s basketball team has lost three straight games, but it might have gotten some very good news on Wednesday afternoon. At least for the short term.

In the court ruling Ohio vs. NCAA, Judge John Bailey issued a temporary restraining order (for the next two weeks) that grants immediate eligibility to any college athlete that is currently seeking a multi-transfer waiver.

Florida State point guard Primo Spears, who transferred to Florida State from Georgetown, is one of those athletes who had been seeking a waiver.

Spears, who started his career at Duquesne, averaged 16 points per game last season for the Hoyas. He was also second in the Big East in assists in 2023, averaging 5.3 per game. He had a career-high 37 points last season against Xavier.

Based on the ruling, Spears could be free to play for the Seminoles on Saturday night when they host SMU at the Tucker Center.

The NCAA said in a statement following Wednesday’s ruling that any player who competes during this 14-day window cannot be retroactively punished and his team can not be punished for his participation in games.

So, that would seem to clear the way for Spears to be eligible — at least for the next two weeks — until the next court date on Dec. 27, 2023.

Spears would clearly be a huge addition for a Florida State team that is struggling after a 4-1 start. The Seminoles are coming off a blowout loss to South Florida on Saturday in the Orange Bowl Classic.

Florida State officials have not yet released a statement on this matter.

Regardless of what happens with this court case, the Florida State football team should have defensive tackle Darrell Jackson available for the Seminoles’ Orange Bowl game with Georgia. He was cleared at the end of the fall semester.
