Louisville Topgolf wants Hurstbourne lawsuit dismissed
Topgolf and its company director of real estate development have asked a Louisville judge to dismiss a lawsuit filed by land-use attorney Stephen Porter, who’s representing residents of Hurstbourne who are against Topgolf being built at the Oxmoor Center.
We’ve written about this a few times on KSR, but the curmudgeons aren’t OK that they’ve lost. They did their best. They showed up. They filibustered. They accidentally fell asleep a few times. They hit up Denny’s. And they lost. Twice. The Planning Commission in Louisville unanimously approved the rezoning of the future Topgolf site and the Metro Council voted 20-3 to allow Topgolf to move to the Oxmoor Center location.

Porter and the anti-Topgolf crowd are suing over the lighting despite experts suggesting the site would put off less light than the previous Sears building. Some Hurstbourne residents believe Topgolf will be too bright, too loud and the partying atmosphere of the venue could lead to more drinking and driving accidents. To make matters worse Porter and his clients may sue the Metro Council’s decision in the next two weeks.
Hopefully the judge will throw out the lawsuit regarding the Planning Commission, but Topgolf still isn’t quite in the clear. Hurstbourne residents are trying to drag their feet but it’s time to roll with Topgolf at the Oxmoor Center.
