If I understand the above excerpt correctly, it only applies to "THE" as a standalone logo. Our apparel with a seal reading "The Pennsylvania State University" looks to be no problem. Leave it to the self-important d-bags to think anyone seeing "THE" will associate it with OSU. The vast majority of people wouldn't know and wouldn't care.
French people would see it and think the person must really like tea regardless of the missing accent aigu. A good troll would be to print up a bunch of French "tea" shirts and wear them around Columbus on game days.
