On3 Media, Inc. (“Company”, “On3” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy. This Children’s Privacy Policy (the “Children’s Privacy Policy”) applies to any websites or mobile applications owned or operated by us, including, without limitation, this website currently located at www.On3.com (collectively, the “Website”) and other online applications, products, services, and experiences we offer to children (collectively with the Website, the “Services”).

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this policy, “parents”) about our practices for collecting, using, and disclosing personal information from consumers under the age of 13. Our Website is not intended for children under 13 years of age and we do not knowingly contact or collect information from persons under the age of 13. If we learn we have collected or received personal information from a child under 13, we will delete that information. This Children’s Privacy Policy only applies to consumers over the age of 13 and under the age of 18 and supplements our general Privacy Policy, available at https://www.on3.com/page/privacy-policy/. Only our general Privacy Policy applies to consumers over the age of 18.

This Policy explains:

·  How we use the Information we collect.

·  How we disclose that Information.

·  How you can access and correct that Information.

Terms that are defined in the general Privacy Policy have the same meanings as used in this Children’s Privacy Policy.

Information We Collect from Consumers

Consumers over the age of 13 can access many parts of the Services and their content and use many of their features without providing us with personal information. However, some content and features require us to collect certain information, including personal information, from them. In addition, we use certain technologies, such as cookies, to automatically collect information from consumers when they visit or use the Website or Services.

When we collect Information from a consumer over 13, we will retain that Information only so long as reasonably necessary to fulfill the purpose for which it was provided or ensure the security of our users and our services, or as required by law. If we learn that our Website or Services have collected Information from a child under 13 or in a way not permitted by applicable law, we will delete the information.

Information We Collect Directly

A consumer over the age of 13 must provide us with the following information to register with this Website or the Services: the full name and an email address. We may also require the consumer to create a member name and password and provide their birth date. We may request additional information from consumers, such as Name, Image, Likeness “NIL” data, but this information is optional. We specify whether information is required or optional when we request it.

We enable users to communicate with others on or through this Website by posting to public areas of the Website and through the On3 High School section of the Website (“Social Features”). The nature of these features allows consumers to disclose Information about themselves. We do not monitor or review this content before it is posted, and we do not control the actions of third parties with whom consumers share his or her Information.

Automatic Information Collection

We use technology to automatically collect Information from our users, including consumers over 13, when they access and navigate through the Website or Services and use certain of its features. The Information we collect through these technologies may include, but is not limited to, the type of browser used, the type of operating system used, the IP address, mobile device ID, aggregate data about the number of visits to the Website, and aggregate data about the pages visited. We also may combine non-personal information we collect through these technologies with personal information about consumers that we collect online.

How We Use Personal Information

We use the Information we collect for:

As required under the CCPA, we do not sell or share the Information of consumers we actually know are over the age of 13 but under the age of 18, unless we receive affirmative consent (the “right to opt-in”) from the consumer .

We may disclose aggregated information about our users. In addition, we may disclose personal information:

·  If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.

·  If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of On3, our consumers or others, including to:

If On3 is involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of On3’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the personal information we have collected or maintain to the buyer or other successor.

Social Features

The Website and Services offer social features, including posting on message boards, which enable consumers to communicate with others through the Website and Services. We do not control the types of Information consumers can send or post.

Accessing and Correcting Personal Information

At any time, consumers may review the Information maintained by us, require us to correct or delete the Information, and/or refuse to permit us from further collecting or using the Information.
